No. The Duty Lawyer Service is an independent organization fully funded by the Government of the Hong Kong SAR and managed by the Hong Kong Bar Association and the Law Society of Hong Kong. It is not part of the Legal Aid Department.
No. All Duty Lawyers are privately practising lawyers who volunteer their time. They are paid for their service and will do their best to protect your interests, just as any private lawyer would.
No. Duty Lawyers will not press any defendants to plead guilty. It is the duty of a Duty Lawyer to explain and advise you about the strength of the case. Whether to plead guilty or not is entirely your decision.
Yes. There is no means test and the service is absolutely free of charge. Volunteer lawyers provide preliminary legal advice to help you understand your legal position.
Yes. A Duty Lawyer may have conference with you prior to the day of hearing if necessary. If more time is needed, the Duty Lawyer will apply to court to have the case stand down.
